Welcome to ButtSnorkelers.com. These Terms of Service ("Terms") govern your use of our website and your purchase of products from ButtSnorkelers International LLC ("we," "us," "our"). By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please close this tab and go snorkel somewhere else.

1. Acceptance of Terms (The Handshake)

By accessing, browsing, or using this Site in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Return Policy, and Cookie Policy. These Terms constitute a legally binding agreement between you and ButtSnorkelers International LLC.

2. Eligibility (Must Be This Tall to Ride)

You must be at least 18 years of age to use this Site or make a purchase. By placing an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are under 18, please ask a responsible adult to buy your snorkel gear for you.

3. Products & Pricing (What You See Is What You Get)

• All products sold on this Site are print-on-demand apparel, accessories, and drinkware, printed and fulfilled by our partner, Printful.
• All prices are listed in US Dollars (USD) and are subject to change without notice.
• We make every effort to display product colors and images accurately, but actual colors may vary slightly due to differences in monitors, screens, and the inherent nature of print-on-demand production. (Your butt sticker may be slightly more or less vivid than depicted.)
• We reserve the right to modify, discontinue, or limit the availability of any product at any time without prior notice.
• Pricing errors are not binding. If we discover an error in the price of a product you ordered, we will contact you to inform you and give you the option to proceed at the correct price or cancel the order.

4. Orders & Payment (Show Us the Money)

• All orders are processed through our secure payment partner, Stripe. We accept major credit cards, debit cards, and other payment methods supported by Stripe.
• By placing an order, you authorize us to charge the payment method you provide for the total order amount, including product cost, applicable taxes, and shipping fees.
• Order confirmation does not guarantee acceptance. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability.
• Since all products are made to order, orders cannot be modified or canceled once production has begun.

5. Shipping & Delivery (The Journey of Your Gear)

• All orders are fulfilled and shipped by Printful. Estimated delivery time is 3-7 business days for US orders after production (production typically takes 2-5 business days).
• International shipping times vary by destination.
• We are not responsible for delays caused by carriers, customs, weather, acts of nature, or other circumstances beyond our control.
• Risk of loss and title for products pass to you upon delivery to the carrier.
• Free US shipping is available on orders over $50.

6. Returns & Refunds (Read This Carefully)

Because our products are printed on demand and custom-made for each order, we have a limited return policy. Please review our full Return Policy for complete details. In summary:

• No returns or refunds for buyer's remorse, change of mind, or incorrect size selection.
• Returns and replacements are accepted only for defective, damaged, or incorrectly shipped items.
• Claims must be submitted within 14 days of delivery with photographic evidence.

7. Intellectual Property (Our Stuff Is Our Stuff)

All content on this Site — including but not limited to text, graphics, logos, images, product designs, illustrations, the ButtSnorkelers name and brand, and all associated trademarks — is the exclusive property of ButtSnorkelers International LLC and is protected by US and international copyright, trademark, and intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any of our content without our prior written consent.
• You may not use our trademarks, logos, or brand name in any manner that suggests endorsement or affiliation without our express permission.
• Purchasing a product does not grant you any intellectual property rights to the designs printed on it. (Owning the sticker does not make you the CEO.)

8. User Conduct (Don't Be Weird About It)

By using this Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable laws
• Attempt to interfere with or disrupt the Site's functionality, servers, or networks
• Submit false or misleading information in connection with an order
• Use automated systems (bots, scrapers, etc.) to access the Site without permission
• Infringe upon or violate the intellectual property rights of ButtSnorkelers or any third party
• Attempt to reverse-engineer, decompile, or extract source code from the Site
• Harass, threaten, or abuse our team (we are nice people who sell funny stickers)

9. Limitation of Liability (The Fine Print Within the Fine Print)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUTTSNORKELERS INTERNATIONAL LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the Site or any products purchased through the Site
• Any errors, inaccuracies, or omissions in product descriptions, pricing, or content
• Unauthorized access to or alteration of your data or transmissions
• Any third-party content, services, or conduct

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

10. Disclaimer of Warranties (As-Is, Baby)

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Indemnification (You've Got Our Back)

You agree to indemnify, defend, and hold harmless ButtSnorkelers International LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site or purchase of products
• Your violation of these Terms
• Your violation of any rights of a third party
• Your violation of any applicable law or regulation

12. Governing Law & Jurisdiction (Home Court Advantage)

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution (Let's Talk It Out)

Before initiating any legal action, you agree to first attempt to resolve any dispute informally by contacting us at SOS@buttsnorkelers.com. We will try to resolve the issue within 30 days. If the dispute cannot be resolved informally, either party may pursue legal remedies as described in Section 12.

14. Modifications to These Terms (We May Switch It Up)

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. The "Last Updated" date at the top of this page will be revised accordingly. Your continued use of the Site after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

15. Severability (If One Part Sinks, the Rest Floats)

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy, Return Policy, and Cookie Policy, constitute the entire agreement between you and ButtSnorkelers International LLC regarding your use of the Site and purchase of products, and supersede all prior agreements, understandings, and communications.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any term shall not be deemed a continuing waiver of that or any other term.
